Terms of service

1. Using the Site

You may use the Site to learn about the rescue, view our adoptable dogs, apply to adopt, foster or volunteer, make a donation, and contact us. You agree to use the Site only for lawful purposes and in a way that doesn't interfere with anyone else's use of it. In particular, you agree not to:

• submit false information in an application, a message, or a donation;
• attempt to gain unauthorized access to the Site, its content system, or the accounts of others;
• use automated tools to scrape, copy or overload the Site, other than search engines indexing public pages;
• upload or send anything unlawful, threatening, abusive or harmful; or
• use the Site to harass our volunteers, fosters or adopters.

2. Adoption, foster and volunteer applications

Submitting an application does not create an obligation on the rescue to place a dog with you, accept you as a foster, or assign you volunteer work. All placements are made at the rescue's discretion, based on the best interests of the dog. Adoptions and fosters are governed by the separate written agreements you sign at the time of placement, and those agreements control if they conflict with these terms.

Information on the Site about a dog, including breed, age, size, temperament and health, is our best understanding at the time it was written, often based on a foster family's observations. It is not a guarantee. Dogs are living animals, and their behavior and health can change. You are responsible for deciding whether a particular dog is right for your household.

The foster application is hosted by Jotform. By submitting it, you also agree to Jotform's terms of use.

3. Donations

Donations made through the Site are processed by Stripe and are subject to Stripe's terms. Let's Rescue Dogs is a 501(c)(3) organization, and donations are tax-deductible to the extent permitted by law; consult a tax professional about your own situation. No goods or services are provided in exchange for donations.

Donations are used at the rescue's discretion for its charitable purposes. A donation made with a particular dog in mind supports our veterinary and care fund as a whole. Monthly donations renew automatically on the same date each month until you cancel, which you can do at any time through the link in your receipt or by contacting us. If you believe a donation was made in error, contact us within 30 days and we will work with you on a refund.

Donations made by Venmo, Zelle or through our Amazon wish list are subject to those services' terms.

4. Street-dog text line

Our text line is monitored by volunteers and is not an emergency service. We cannot guarantee a response time, and we cannot promise to take in a particular dog. For an animal in immediate danger, contact an emergency veterinarian or your local animal control agency. Nothing on the Site is veterinary advice; the guidance on our found-a-dog page is general information only.

5. Content and intellectual property

The text, photographs, logo, illustrations and design of the Site belong to Let's Rescue Dogs or are used with permission. You may share links to our pages and share our adoptable dogs on social media, including their photos and descriptions, for the purpose of helping them find a home. Any other reproduction, republication or commercial use of Site content requires our written permission. The Let's Rescue Dogs name and logo may not be used to suggest endorsement or affiliation without our consent.

Petfinder listings and photographs hosted by Petfinder are subject to Petfinder's terms.

6. Content you send us

If you send us photos, stories or other material (for example, an update about a dog you adopted), you give us permission to use it on the Site and in our communications and social media to promote the rescue's work, and you confirm you have the right to share it. We'll credit you where practical and remove material at your request where we reasonably can.

7. Third-party services and links

The Site relies on and links to third-party services, including Stripe, Jotform (the foster application), Petfinder, Instagram, TikTok, Facebook, Venmo, Zelle and Amazon. We don't control those services and aren't responsible for their content, availability or practices.

8. Disclaimers

The Site is provided "as is" and "as available." To the fullest extent permitted by law, Let's Rescue Dogs disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement, and does not warrant that the Site will be uninterrupted, error-free or free of harmful components. We work hard to keep the Site accurate and current, but we can't guarantee that every listing or piece of information is complete or up to date.

9. Limitation of liability

To the fullest extent permitted by law, Let's Rescue Dogs and its directors, officers, volunteers and agents will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, arising out of or relating to your use of the Site, even if advised of the possibility. Our total liability for any claim relating to the Site will not exceed one hundred dollars ($100) or the amount you donated through the Site in the twelve months before the claim, whichever is greater. Some jurisdictions don't allow certain limitations, so some of these may not apply to you.

Nothing in these terms limits liability for anything that can't be limited under applicable law, and nothing here affects the terms of a separate adoption or foster agreement.

10. Indemnity

You agree to indemnify and hold harmless Let's Rescue Dogs and its volunteers from claims, losses and expenses (including reasonable attorneys' fees) arising from your violation of these terms or your misuse of the Site.

11. Governing law and disputes

These terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. Any dispute relating to the Site will be brought in the state or federal courts located in California, and you consent to their jurisdiction. Before filing a claim, please contact us; most concerns can be resolved with a conversation.

12. Changes

We may update these terms from time to time. The date at the top shows when they last changed. Continued use of the Site after a change means you accept the updated terms.
